541 – Non-NHS services by pharmacists and pharmacy technicians in Scotland

Under the Health and Social Care Act 2008, providers of health services must be registered with the Care Quality Commission in England, Health Improvement Scotland, or Healthcare Inspectorate Wales.

In Scotland, independent clinics where services are provided by pharmacists and pharmacy technicians have not been regulated unless those services are provided from premises registered with the GPhC or the services are provided under the NHS.

The Healthcare Improvement Scotland (Inspections) Amendment Regulations 2024, amending the National Health Service (Scotland) Act 1978, will come into force on 19 June 2024. Following a 12-month transitional period, where pharmacists and pharmacy technicians provide services from unregulated clinics and in relation to providers of healthcare online, they will be regulated by Health Improvement Scotland. This regulation will not apply to services provided in registered pharmacies and/or under the NHS
